The purpose of this Long Briefing Note is to provide the European Parliament a clear, balanced, and systematic picture of the variety of views seriously considered among professionals in the field, including the contractor’s independent assessment on the Posting of Workers Directive. This assignment will have to take adequately into account the difficulty to achieve a balance between the freedom to provide services in another Member State, to which companies may post their workers temporarily, and the protection of workers against discrimination as regards employment, remuneration and other conditions of work and employment in comparison to nationals of the host Member State.

The study envisages:

  • Literature review on implementation of the Posting Directive and of the Enforcement Directive in the EU Member States, the ECJ case law and its implications, notable administrative cooperation practices and inspection activities and their compliance with the Directives in the light of the ECJ case law.
  • Literature review and data collection on the economic dimension of the phenomena
  • Interviews with key stakeholders
  • Drafting a Long Briefing Note
