The use of gender in insurance pricing

On 1 March 2011 the European Court of Justice (case C-236/09, Test Achats) intervened in a strategic sector from the economic point of view, i.e. the insurance sector, applying Council Directive 2004/113/EC implementing the principle of equal treatment between men and women in the access to and supply of goods and services. This report points out the potential consequences the judgement might lead to, both in the insurance and bank sector, and on the overall systematic level, outlining its impacts on gender as well. More generally, the judgment has significant consequences in the fight against discrimination based on factors other than gender (ethnic group, sexual orientation, religion, etc.).
